This page is an English translation provided for convenience. The Seller is established in France and the contract is concluded in French: in the event of any discrepancy, the French terms and conditions of sale prevail.
Article 1 · Purpose and scope
These terms and conditions of sale govern the online sale of the training program The Fortuna Method by the Seller defined in article 2, to any natural person acting for non-professional purposes (the “Customer”).
Every order implies unreserved acceptance of these terms, which the Customer acknowledges having read before validating the order by ticking the box provided for that purpose. The applicable terms are those in force on the date of the order. The Customer may save or print them.
Article 2 · Identification of the Seller
[to be completed: first and last name of the entrepreneur], sole trader (French micro-entreprise), trading under the business name “The Fortuna Circle” · SIRET [to be completed: SIRET number] · [to be completed: registered address] · contact@thefortunacircle.com
VAT not applicable, article 293 B of the French General Tax Code.
Article 3 · Description of the program
The Fortuna Method is an online training program made up of written digital content supplied without a tangible medium: eight modules, forty lessons, exercises and five resources (the Fortuna Atlas, the Script Notebook, the 90-Day Plan, the Protection File and the Presence Kit). Its essential characteristics are presented on the sales page, which the Customer is invited to read carefully before ordering.
The program includes no individual or group support (no coaching, no live session, no discussion group).
No guarantee of results. The program passes on methods, information and tools. It guarantees no result, in particular no meeting and no relationship, which depend on the Customer’s own actions and on the free will of third parties. Content relating to law and personal wealth is provided as general information and does not replace the advice of a professional (notary, lawyer, wealth adviser).
The program is reserved for adults.
Article 4 · Prices
Prices are stated in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code.
- Founding edition: €690 in a single payment, or €720 in three monthly installments of €240.
- The founding edition is limited to five sales. Once that number is reached, the order form is closed.
The Seller reserves the right to change prices at any time. The applicable price is the one displayed when the order is validated.
Article 5 · Ordering
The order is placed on the online order form (methode.thefortunacircle.com): the Customer enters her details, chooses her payment method (single payment or three installments), takes note of these terms and of the privacy policy by ticking the box provided, then validates her payment. The order is firm as soon as payment is confirmed. A confirmation email summarizing the order is sent to the Customer.
Article 6 · Payment
Payment is made by bank card or by the other means offered on the order form, through the secure provider Stripe. The Seller never has access to the Customer’s card details.
Where payment is made in three installments, the Customer authorizes the collection of the two following installments, one month apart, from the same payment method. If an installment fails and is not regularized after a reminder, the Seller may suspend access to the program until the amounts due are paid.
Article 7 · Access to the program
Access is opened immediately after payment is confirmed: the login details for the course area are sent by email to the address given at the time of the order. If they are not received, the Customer contacts the Seller at contact@thefortunacircle.com.
Access is personal and unlimited in time, for as long as the Seller operates the program. Login details must not be passed to third parties. The program is accessible from a computer, a tablet or a smartphone with an internet connection and an up-to-date browser.
Article 8 · Right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, the Customer has fourteen days from the conclusion of the contract to exercise her right of withdrawal, without having to give reasons and without bearing any costs other than those provided for by law.
To exercise it, the Customer sends the Seller, before that period expires, an unambiguous statement, by email to contact@thefortunacircle.com, or using the model form set out in the annex.
The Seller refunds all sums paid at the latest fourteen days after receiving the request, using the same payment method as the one used for the order. Any remaining installments are canceled and access to the program is closed.
Article 9 · Satisfaction guarantee
In addition to the right of withdrawal, and without prejudice to it, the Seller grants a commercial guarantee: for fourteen days following the order, the Customer may request a full refund of her order, without justification, by email to contact@thefortunacircle.com. The refund is made under the same conditions as in article 8.
Article 10 · Legal guarantee of conformity
The Seller is required to supply digital content that conforms to the contract, under the conditions of articles L.224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity (content inaccessible, incomplete or not matching its description), the Customer may obtain the content to be brought into conformity or, failing that, a reduction in price or termination of the contract.
Article 11 · Intellectual property
The program and all of its content are the exclusive property of the Seller and are protected by copyright. The order grants the Customer a strictly personal and non-transferable right of use. Any reproduction, distribution, resale or making available of all or part of the program, by any means whatsoever, is prohibited and may result in access being closed without refund, without prejudice to legal proceedings.
Article 12 · Liability
The Seller uses reasonable means to ensure access to the program. The Seller cannot be held liable for a temporary interruption due to maintenance, to a failure of technical providers or to force majeure. The Seller cannot be held responsible for the decisions the Customer makes in her personal life, nor for their consequences.
Article 13 · Personal data
The data collected when ordering is necessary to perform the order. Its processing is described in the privacy policy. The Customer has a right of access, rectification, erasure, restriction, objection and portability, exercised at contact@thefortunacircle.com.
Article 14 · Customer service and mediation
For any question or complaint, the Customer contacts the Seller at contact@thefortunacircle.com. The Seller undertakes to reply within 72 working hours.
Where a dispute remains unresolved after a prior written complaint, the Customer may refer the matter free of charge to the consumer mediator, in accordance with articles L.611-1 et seq. of the French Consumer Code: [to be completed: name, address and website of the mediator].
Article 15 · Governing law
These terms are governed by French law. Failing an amicable settlement, the dispute may be brought before the competent court under ordinary law. The Customer may, at her choice, bring the matter before the court of the place where she was living when the contract was concluded. Nothing in these terms deprives a consumer resident in another country of the mandatory protective provisions of the law of her country of residence.
